1. Who we are
1.1 These terms apply to all orders placed by consumers on the Maison Forma online shop (maisonforma.uk). A consumer is an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
1.2 The seller is Maison Forma, Yoann Bourin EI (sole trader), 11 Rue des Archers, 51200 Épernay, France, registered with the RCS of Reims under number 887 865 178. Email: contact@maisonforma.uk. Phone: +44 7458 107 257.
1.3 Please read these terms before placing an order. They do not affect your statutory rights.
2. Our products
2.1 Product images are for illustration. We make every effort to show colours and materials accurately, but the colour you see depends on your screen, and slight shade differences can occur between production batches.
2.2 Decorative items shown in photos are not included unless stated in the product description.
2.3 Our sofas and armchairs are delivered compressed in a box. Once unpacked, the foam expands and reaches its final shape after 24 to 48 hours. A compressed sofa cannot be compressed again once unpacked.
2.4 Please check the product dimensions and the access to your home (doors, stairs, lifts) before ordering.
3. How the contract is formed
3.1 The products shown on our website are an invitation to order, not a binding offer.
3.2 You place an order by clicking the final order button at checkout. Before that, you can review and correct your details at any time.
3.3 After you place your order, you receive an automatic email acknowledging it. The contract between you and us is formed when we send you this order confirmation email, or at the latest when we dispatch the goods.
3.4 The contract is concluded in English. We store your order details, and you receive them by email together with a link to these terms.
3.5 If a product turns out to be unavailable after you order, we will tell you promptly and refund any payment in full.
4. Prices
4.1 Prices are shown in pounds sterling (GBP).
4.2 Delivery to mainland UK is free (see our Delivery and payment policy).
4.3 The price shown at checkout is the total price you pay. There are no customs duties, import VAT or clearance fees to pay on delivery.
4.4 If we make an obvious pricing error on our website, we will contact you before dispatch. You can then confirm the order at the correct price or cancel it and receive a full refund.
5. Payment
5.1 You can pay with the payment methods shown at checkout: debit or credit card, Apple Pay, Google Pay and PayPal.
5.2 Payment is taken when you place your order, unless the payment method you choose states otherwise.
5.3 If you use a pay-later or instalment option offered at checkout, it is provided by a third-party provider under its own terms and is subject to eligibility.
6. Delivery
6.1 We deliver to addresses in mainland Great Britain (England, Wales and mainland Scotland). We currently do not deliver to Northern Ireland, the Scottish islands (including the Hebrides, Orkney and Shetland), the Isles of Scilly, the Channel Islands or the Isle of Man. Delivery takes 8 to 14 working days from the order confirmation, unless a different time is shown on the product page.
6.2 If we cannot deliver within 30 days of the contract, you may treat the contract as at an end and receive a full refund, as provided by the Consumer Rights Act 2015.
6.3 The goods are your responsibility from the moment they are delivered to you or to a person you have named. Ownership passes to you when we have received full payment.
6.4 Please report any visible transport damage to the driver if possible. Your statutory rights remain unaffected if you do not.
7. Your right to cancel
7.1 You have a statutory right to cancel your order within 14 days without giving any reason. Full details and the model cancellation form are in our Right to cancel and returns policy.
7.2 In addition, we offer a voluntary returns period of 30 days in total from receipt of the goods, on the same terms as the statutory right to cancel. This does not affect your statutory rights.
8. Your statutory rights
8.1 We are under a legal duty to supply products that are of satisfactory quality, fit for purpose and as described. Your statutory rights under the Consumer Rights Act 2015 include:
- a short-term right to reject faulty goods and receive a full refund within 30 days of delivery;
- if the fault appears after 30 days, or if you prefer, a right to a repair or replacement;
- if a repair or replacement is not possible or does not fix the problem, a right to a price reduction or a refund.
8.2 If a product is faulty, please email us at contact@maisonforma.uk with your order number and photos. We pay the cost of returning faulty goods and arrange the collection of large items.
8.3 We do not offer any commercial guarantee in addition to your statutory rights, unless one is expressly stated on the product page.
9. Our liability
9.1 If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence.
9.2 We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your statutory rights.
9.3 Our products are supplied for domestic and private use only. We are not liable for any loss of profit, loss of business or business interruption.
10. Complaints
If you have a complaint, please contact us at contact@maisonforma.uk. We aim to resolve every complaint within 14 days. We are not obliged to, and do not, use an alternative dispute resolution (ADR) provider. For free advice on your rights, you can contact the Citizens Advice consumer helpline on 0808 223 1133.
11. Personal data
We use your personal data as described in our Privacy policy.
12. Law and courts
12.1 These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you also benefit from the mandatory consumer protection rules of the place where you live.
12.2 You can bring legal proceedings in the courts of England and Wales, or in the courts of Scotland or Northern Ireland if you live there.
13. Other
If any provision of these terms is found to be invalid, the other provisions remain in force. We may update these terms from time to time; the version in force at the time of your order applies to that order.
